Please read these Terms and Conditions carefully before using OpTYXo. By using the platform, you expressly accept these terms. If you do not agree, please do not use the service.

1. Definitions

• "Platform" / "Service" — the OpTYXo website and web application at https://optyxo.com
• "User" — any person or entity accessing or using the Platform
• "Account" — a personal account created on the Platform
• "Subscription" — an active paid service plan on the User's account

2. Service Description

OpTYXo is an automated SEO audit platform providing technical analysis of websites. Results are generated automatically and are informational only — they do not constitute professional advice and do not guarantee improvements in search engine rankings.

3. Account Creation and Security

A registered account is required to access full functionality. You agree to:

• provide accurate, current and complete information at registration
• maintain the confidentiality of your login credentials
• immediately notify us of any unauthorized use of your account
• not create multiple accounts to circumvent free plan limits

4. Plans, Pricing and Payment

The Platform offers a free plan with limited features and paid plans. Prices are displayed on the pricing page and are in EUR or RON, inclusive of applicable VAT.

Payments are processed via Stripe. We do not store your card data. Subscriptions renew automatically monthly and can be cancelled at any time from your profile, effective at the end of the current billing period.

5. Refund Policy (Right of Withdrawal)

Under EU consumer law, you have the right to withdraw from a subscription contract within 14 calendar days of subscribing, without justification.

Exception: if you have actively used the service during this period (generated audits), the right of withdrawal may be proportionally affected by the service rendered.

6. Acceptable Use

You must not use the Platform to:

• audit websites without the legal right to analyze them
• generate artificial traffic or DoS/DDoS attacks
• scrape or process data for unauthorized resale
• use bots or automated scripts to circumvent usage limits
• infringe third-party intellectual property rights
• engage in any illegal activity

7. Intellectual Property

All Platform content (source code, design, text, logos, generated reports) is owned by OpTYXo or its licensors and is protected by copyright law. You receive a limited, non-exclusive, non-transferable licence to use the Service.

8. Service Availability

We strive to keep the Platform continuously available but do not guarantee 100% uptime. We reserve the right to temporarily suspend the Service for maintenance or updates, with prior notice where possible.

9. Limitation of Liability

The Service is provided "as is". We do not warrant that audit results are exhaustive or error-free, or that implementing recommendations will produce specific SEO results.

To the extent permitted by law, our total liability for direct damages shall not exceed the amount paid by the User in the last 3 months. We are not liable for indirect damages, loss of profit, or loss of data.

10. Data Protection

Processing of your data is governed by our Privacy Policy, which forms an integral part of these Terms.

11. Governing Law and Dispute Resolution

These Terms are governed by Romanian law. Disputes shall be resolved amicably where possible. If not, Romanian courts shall have jurisdiction.

EU consumers may use the Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

12. Changes to These Terms

We may modify these Terms. Significant changes will be communicated at least 15 calendar days before taking effect, by email or in-platform notification. Continued use after that date constitutes acceptance of the new terms.
